E.P.A. Upholds Ethanol Standard on Use in Gasoline

A summer drought that withered crops led to a spike in prices, hurting the livestock industry and others that depend on corn for food. Estimates indicate that as much as half of the nation?s crop will be used to produce ethanol this year to meet the federal renewable energy standard for transportation fuel.

?We recognize that this year?s drought has created hardship in some sectors of the economy, particularly for livestock producers,? Gina McCarthy, an E.P.A. assistant administrator, said in a statement. ?But our extensive analysis makes clear that Congressional requirements for a waiver have not been met.?

To approve a change in the standard, the agency would have to conclude that the fuel rule would ?severely harm? the economy. The E.P.A. said it had analyzed 500 potential market variations and that most of them showed no impact from the use of corn for ethanol; those that did showed an average impact of 7 cents a bushel, less than 1 percent of the price, it said.

A coalition of livestock groups expressed frustration with the decision, as did the National Council of Chain Restaurants, which says its costs have also risen because of the use of corn in ethanol production.

Several environmental groups are also opposed to the ethanol requirement, saying that corn ethanol production is not clean energy. ?If the worst U.S. drought in more than 50 years and skyrocketing food prices are not enough to make E.P.A. act, it falls to Congress to provide relief from our senseless federal support for corn ethanol,? Michal Rosenoer, a biofuels specialist at Friends of the Earth, said in a statement. She said the mandate was ?exacerbating our economic and environmental problems.?

That would put some environmentalists in rare alignment with the oil industry, which is required to use an increasing amount of ethanol in its fuel production but complains that its system is glutted with the substance.

Since Congress specified a year-by-year gallon quota for biofuels in 2007, total fuel demand in the United States has dropped, so the percentage of ethanol fuel in gasoline has reached unexpected highs.

Farm groups and trade associations for companies seeking to make ethanol from nonfood sources like wood chips or crop residues have applauded the mandate, however. They say that if the corn ethanol mandate is reduced, there will be less demand for their biofuels products as well.

At the Advanced Ethanol Council, Brooke Coleman, the executive director, pointed out that the quota rules include a provision that allows the oil industry to postpone up to 20 percent of its obligation to a future year ?if there is a good year one year and a less good year the next.?

At Novozymes, which supplies enzymes to ethanol manufacturers, Adam Monroe, president of the company?s North American division, said the biofuels mandate ?has generated 400,000 careers, billions in private investment, and domestic, renewable fuel for America.?

In the longer term, Congress anticipates substantial production of biofuels from nonfood sources, but so far that has not developed.

(AP) ? Hewlett-Packard Co. said on Tuesday that it's the victim of a multi-billion dollar fraud at the hands of a British company it bought last year that lied about its finances.

HP CEO Meg Whitman said executives at Autonomy Corporation PLC "willfully" boosted the company's figures through various accounting tricks, which convinced HP to pay $9.7 billion for the company in October 2011.

Autonomy's former CEO said HP's allegations are false.

HP is now taking an $8.8 billion charge to align Autonomy's purchase price with what HP now says is its real value. More than $5 billion of that charge is due to false accounting, HP said.

The revelation is another blow for HP, which is struggling to reinvent itself as PC and printer sales shrink. The company's stock hit a 10-year low in morning trading.

Among other things, Autonomy makes search engines that help companies find vital information stored across computer networks. Acquiring it was part of an attempt by HP to strengthen its portfolio of high-value products and services for corporations and government agencies. The deal was approved by Whitman's predecessor, Leo Apotheker, but closed three weeks into Whitman's tenure as chief executive. Whitman was a member of HP's board of directors when Apotheker initiated the Autonomy purchase.

Among the tricks used at Autonomy, Whitman said: The company had been booking the sale of computers as software revenue and claiming the cost of making the machines as a marketing expense. Revenue from long-term contracts was booked up front, instead of over time.

As a result, Autonomy appeared to be more profitable than it was and seemed to be growing its core software business faster than was actually the case. The moves were apparently designed to groom the company for an acquisition, Whitman said.

Once HP bought the company, Autonomy's reported revenue growth and profit margin quickly declined. Autonomy CEO Mike Lynch continued to run the company as part of HP, but Whitman forced him out on May 23 because it was not living up to expectations.

"Little did I know that there was more than met the eye," Whitman said.

With Lynch gone, a senior Autonomy executive volunteered information about the alleged accounting irregularities, prompting an internal investigation, Whitman said.

The case has been referred to the U.S. Securities and Exchange Commission and the UK's Serious Fraud Office, she said. The company will also try to recoup some of the cash it paid for Autonomy through lawsuits.

In a statement to the Financial Times, Lynch said "The former management team of Autonomy was shocked to see this statement today, and flatly rejects these allegations, which are false."

"It took 10 years to build Autonomy's industry-leading technology and it is sad to see how it has been mismanaged since its acquisition by HP," he added.

On a conference call with Whitman following the earnings report, analyst Ben Reitzes of Barclays Capital asked who will be held responsible internally for the disastrous acquisition.

Whitman answered that the two executives who should have been held responsible ? Apotheker and strategy chief Shane Robison ? are gone. But the deal was also approved by the board of directors.

"Most of the board was here and voted for this deal, and we feel terribly about that," Whitman said. "What I will say is that the board relied on audited financials. Audited by Deloitte ? not 'Brand X' accounting firm, but Deloitte. During our very extensive due diligence process, we hired KPMG to audit Deloitte. And neither of them saw what we now see after someone came forward to point us in the right direction."

Apotheker told The Associated Press on Tuesday that he was "stunned and disappointed" to learn of the allegations against Autonomy, and pointed out that they had gone undiscovered by HP's auditors, executives and directors.

Deloitte UK said it could not comment on the matter because of client confidentiality rules.

Whitman said she still views Autonomy as a "growth engine for HP software," albeit a weaker one than initially thought. HP has been attempting to morph itself into a company that not only makes computer hardware but one that delivers software and services, too.

HP's stock dipped $1.59, or 12 percent, to $11.72 in afternoon trading. Just after the market's open, the stock hit $11.35, its lowest level since 2002.

HP's net loss for the fiscal fourth quarter, which ended Oct. 31, amounted to $6.85 billion, or $3.49 per share. That compares with net income of $239 million, or 12 cents per share, in the same period last year.

It was the second mammoth loss in a row for HP. In the third fiscal quarter, it lost a record $8.86 billion, or $4.49 per share. That was due to a charge for another acquisition ? that of Electronic Data Systems, a technology consulting service that it bought for $13 billion in 2009. In that case, HP didn't blame improper accounting, just results that didn't live up to expectations.

Excluding the charges in the latest quarter, HP earned $1.16 per share in the latest quarter, just above the average analyst forecast of $1.14 per share, as polled by FactSet.

HP's revenue was $30.0 billion, down 7 percent from last year. That was below analyst expectations at $30.5 billion.

The Palo Alto, Calif., company stuck to its previously given earnings forecast for the fiscal year that just started, but it issued a forecast for this quarter that was well below analyst expectations. It expects earnings, excluding items, to be 68 cents to 71 cents per share, while analysts were looking for 85 cents, according to FactSet.

For decades, the concept of management has remained relatively intact. It?s actually quite simple, oversee a group function in a way that drives maximum effort and production.? Historically, if systems were enacted to provide structure to our efforts, we believed we could perform well.

Today, we see a generation of employees who yearn less for the iron clad fist of management and more for balance of heart and mind.? I call this management the ?Decision at the Door.?? Everyday employees walk into their places of employment and consciously or sub-consciously decide if it?s going to be a 45% day, a 65% day, or perhaps a 90% day. Each day, employees are already determining the limits of their efforts before they have even walked through the door.? Blame it on culture or generation, it is happening.? As leaders, we can?t curb the cultural evolution of employees but rather understand it. We can create value- building management systems that cause employees to make a pro-active decision to work more 90% days than 45% days.

Why the shift in effort mentality?

Build value in the relationships that exist and the ones that have yet to be built.? As social beings, people want to know how they fit into the organization?s big picture.? Employees want to know that there are relationships available that will enhance their skills as well as hold them accountable when expectations are not met.

The ?Whys? Behind It

Historically, any conversation around the importance of expectations has been viewed as a negative confrontation.? Managers too often correlate the ?whys? conversation to a notion that the employee must not be committed to a level of high performance.? The best cultures communicate often, and communicating the ?whys? only strengthens a winning culture.? Like negative feedback, employees will look at it through the eyes of a victim or the scope of an analyst.? A victim will struggle to move forward and is more concerned with the fear of accountability.? The analyst, however will be grateful to have been afforded information that will now aid in developing additional skills.? Going over the ?whys? is a great exercise to develop more analysts.

The Decision at the Door really comes down to how much value employees see in their managers and in their organizations.? While we can?t directly control how our employees view us, we can lead in a way that continually shapes the value in their efforts.? We can manage the balance of heart and mind to draw out commitment versus compliance to their roles and responsibilities.

Church of England decision day on female bishops; vote by lay members is crucial

LONDON - The Church of England's governing body is voting on whether it will permit women to serve as bishops or continue debating the issue for several more years.

The push to muster a two-thirds majority among lay members of the General Synod is expected to be close on two votes, beginning with whether to adopt the legislation as English law. A second vote would follow on whether to incorporate the change in church law.

Votes among bishops and clergy in the synod are expected to pass easily. Archbishop Rowan Williams and his successor, Bishop Justin Welby, both strongly support the change.

If the measure fails, church officials say it could take five years to go through all the steps leading up to another vote.
